$25M Settlement for Children Injured in Bedford Park Pursuit

CHICAGO, Illinois – Jack J. Casciato of Curcio & Casciato has secured a $25,000,000 settlement on behalf of two young children who suffered catastrophic, permanent injuries after a man stole a Bedford Park police SUV, fled from officers through multiple southwest suburban communities, hijacked a USPS truck, and crashed into the vehicle carrying the children.

The lawsuit alleged that the tragedy was entirely preventable.

According to the complaint, Bedford Park police officers had multiple encounters with Miguel Alvarado throughout the day, during which officers allegedly recognized that he was experiencing a mental health crisis and posed a danger to the public. Despite repeated warning signs, the lawsuit alleged officers failed to pursue available mental health intervention, left a police SUV unlocked and running in violation of department policy, and allowed Alvarado to gain access to the vehicle before initiating an unnecessary pursuit.

The pursuit crossed several jurisdictions before Alvarado abandoned the police vehicle, hijacked a United States Postal Service truck, and violently crashed into the vehicle occupied by siblings Mohammad Odeh and Afaf Odeh.

Mohammad sustained a catastrophic traumatic brain injury requiring extensive neurosurgical treatment.

Afaf suffered a devastating spinal cord injury that left her permanently paralyzed.

The evidence demonstrated that this tragedy did not begin with the crash,” said attorney Jack J. Casciato, partner at Curcio & Casciato. “It began hours earlier, when repeated opportunities existed to protect the public from an individual officers themselves recognized was in crisis. Our clients’ lives were forever changed by a series of preventable decisions.”

The lawsuit alleged officers violated their own policies by leaving a marked police SUV unlocked and running near Alvarado, despite earlier incidents in which he allegedly demonstrated erratic behavior and attempted to gain access to a police vehicle. The complaint further alleged the officers initiated an unauthorized pursuit after Alvarado fled in the squad car.

During litigation, extensive body-worn camera footage, police policies, and sworn testimony were developed concerning the officers’ decisions before and during the incident. Plaintiffs alleged these actions constituted willful and wanton conduct under Illinois law.

After extensive litigation, the parties reached a $25 million settlement resolving the children’s injury claims.

This resolution provides significant financial security for two children who will require lifelong medical care,” Casciato said. “While no settlement can restore what these children lost, we hope this case encourages law enforcement agencies everywhere to recognize that established safety policies exist for a reason and that protecting the public must always remain the highest priority.”

The settlement for the children’s permanent injuries resolves claims arising from the March 19, 2025 incident in Bedford Park, Illinois.
