We are therefore proud to offer examples of some settlement and jury verdicts we have earned. $ 6,400,000 – Settlement Plaintiff was a 13 year-old boy that was riding his bicycle along Harlem Avenue near the L tracks at Lake Street when a dump truck backed into the roadway and struck the child causing serious and life threatening injuries. The defendants initially denied liability and retained an accident reconstruction expert who concluded that the plaintiff was responsible for the collision. After the conclusion of discovery, including the deposition of the defendant’s accident reconstruction expert that raised significant questions as to the credibility of the experts conclusions, Joseph R. Curcio was able to negotiate a settlement in the amount $6,400,000 from the defendant. $ 5,600,000 – Settlement Plaintiff was a 5 year-old girl that was admitted to a Chicago-area hospital for an elective surgery to correct a congenital abnormality to her esophagus. During the procedure, the anesthesiologist and surgical staff at the hospital failed to properly clear the air lines that delivered the anesthesia and an air bubble was introduced into the blood stream causing significant brain damage to the child. $ 4,100,000 – Settlement Plaintiff was a 9 year-old girl that was struck by a tractor-trailer while walking in the parking lot of a Walgreen’s drug tore in Madison, Wisconsin. As a result of the impact, she sustained severe crushing and de-gloving injuries to her pelvis and lower extremities. Joseph R. Curcio was admitted pro hac vice to the bar in Wisconsin in order to represent this severely injured minor, and just before trial was able to negotiate a settlement from the trucking company for their negligent operation of the truck as well as the property owner based upon the dangerous design and permitted use of its parking lot in the amount of $4,100,000. $ 3,500,000 – Settlement Plaintiffs were an operator and passenger in a vehicle that collided with a school bus that turned left into their path of travel. One of the plaintiffs suffered a fractured femur and knee and the other a fractured knee and ankle, with both plaintiffs requiring significant hospitalization and follow-up treatment in addition to lost time from work. At mediation, Joseph R. Curcio and John A. O’Meara were able to negotiate a settlement for the plaintiffs in the amount of $3,500,000. $ 2,600,000 – Settlement Plaintiff was operating a motor vehicle on a rural road that collided with a pick-up truck that was owned and operated by a local dairy farm in Kankakee County, Illinois. The plaintiff, a 33 year-old woman and mother of 4 died as a result of the injuries sustained in the collision. At the outset of the case, the defendants denied any fault and petitioned the court to remove the case to a downstate county where verdicts and settlements have traditionally been low and very favorable to businesses and insurance companies. Curcio Law Offices was able to persuade the court in Cook County to maintain its jurisdiction over the case. After several dozen depositions of witnesses were taken in preparation for trial, Joseph R. Curcio and John R. Gorey were able to negotiate a settlement in the for the plaintiffs in the amount of $2,600,000. $ 2,129,141 – Verdict Offer Before Trial - $ 150,000 Plaintiff was a passenger in a vehicle that collided with a FedEx Ground truck at the intersection of Halsted and 99th Street in Chicago. The plaintiff suffered a fractured ankle that required three surgeries and lost time from work as a security guard. Each of the drivers claimed the other ran a red light and were unwilling to meet the plaintiff’s settlement demand of $1,000,000. At trial, Joseph R. Curcio persuaded the jury to find both of the drivers liable and award the plaintiff $2,129,141. $1,200,000 – Settlement Plaintiff was a 28 year old woman and mother of two that was shopping in a remnant carpet store when a wooden rack that held rolls of carpet collapsed, burying the plaintiff and causing her death by suffocation. The defendant carpet store was insured for only $500,000 and the insurance company for the building that housed the store had gone into liquidation, which significantly impacted the likelihood of a meaningful recovery for the plaintiffs. However, the pre-suit investigation conducted by Curcio Law Offices revealed several other related business entities that were liable for the incident. At mediation, Joseph R. Curcio and John R. Gorey were able to successfully negotiate a settlement for the plaintiff in the amount of $1,200,000. $ 1,000,000 – Settlement Plaintiff is a 64 year old woman who was not diagnosed with lung cancer until it had already reached stage 4. The pre-suit investigation conducted by Curcio Law Offices revealed that the plaintiff had an abnormal finding in a chest x-ray that one of her physicians failed to recognize as significant and therefore failed to properly order follow-up diagnostic treatment which would have led to a significantly earlier diagnosis of cancer at a stage where treatment is more effective. Once suit was filed, the physician denied liability and alleged that the abnormal finding had been communicated to the plaintiff with instructions for follow-up treatment and that the plaintiff ignored this medical advice for 22 months when her eventual diagnosis was made. Curcio Law Offices took up the difficult challenge of undermining the credibility of the physician’s defense and after several depositions and other pre-trial motions, the defendants agreed to a settlement in the amount of $1,000,000 in order to avoid the upcoming trial. $850,000 – Settlement Plaintiff was a 74 year old woman who was an in-patient at a local hospital for treatment of cancer that died as a result of multi-organ failure. When the family retained Curcio Law Offices to evaluate the care she received it was determined that she had been given an incorrect dosage of methotrexate which caused her to go into toxic shock resulting in her death. Neither the hospital, her treating physician or the consulting physicians that were named as defendants in the case were able to timely ascertain that the plaintiff had been given this lethal dosage and asserted that her pre-existing cancer led to her demise. After lengthy discovery and a series of pre-trial conferences before the presiding judge, Joseph R. Curcio was able to successfully negotiate a settlement from all of the defendants in the amount of $850,000.
